Self Represent or Hire a Divorce Attorney or Family Lawyer

The trend of self-representation in family courts has seen a significant rise in recent years, with some courts reporting up to 80% of litigants representing themselves. It is worth noting that divorce proceedings can be financially challenging, not only for the poor but also for the middle class.

The high cost of legal services has made it difficult for many people to obtain legal representation, particularly in divorce BC cases. This has led to a growing sense of unfairness in the justice system, with many feeling that the odds are stacked against them large legal firms charging $1,000 - $1,200 per hour have made self-representation the only option for many, which can be a daunting prospect.

Lawyers charge by billable hours and 1/10 hour increments or every 6 minutes.  Based on rate x time spent = cost. Just think if your lawyer charges $1,000 an hour then a phone call lasting 7 - 12 minutes billed at .2 hours would be $200.!!!

Retainers are a standard requirement for lawyers, including family lawyers in BC. The initial retainer amount can vary depending on the complexity of the case, ranging from $3,000 to $30,000, and even higher (up in the $100's of thousands) for more intricate cases. It's important to note that retainers are only the initial payment and can be exhausted quickly, particularly with the high rates charged for every small task.

According to the Legal Fees Survey 2021 conducted by Canadian Lawyer Magazine, we see on average one day in court costs between $4,000 - $7,000.  A 2 day family court trial roughly $19,481. and a 5 day family court trial roughly $43,481. This money has to come from somewhere and that somewhere is your pocket!!

When it comes to separation and divorce BC, the willingness of both parties to work towards a shared resolution can have a significant effect on the final costs. If one party is determined to argue and not make compromises, the legal fees could skyrocket. It's important to keep this in mind and try to find common ground to avoid unnecessary expenses.
